Terms of Service

1. B2B trader warranty

By using CitedIndex — and especially by purchasing the Verified or Featured tier — you warrant that you are acting in the course of trade, business, craft, or profession within the meaning of Article 6:230g of the Dutch Civil Code (Burgerlijk Wetboek) and EU Directive 2011/83/EU on consumer rights.

Because you are not a consumer, the consumer-protection regime — including the 14-day right of withdrawal under Art. 6:230o BW and equivalent EU rules — does not apply to your purchase.

2. No refunds. All sales final.

Paid listing tiers (currently Verified at $15 and Featured at $49) are one-time, lifetime purchases. They are non-refundable. There are no partial refunds, no pro-rated refunds, and no refunds following editorial removal, scope re-evaluation, or discontinuation of the directory.

To restate: all sales are final. We do not offer refunds. We may, at our sole discretion, grant a credit or an exchange (for example, applying a Verified payment toward a Featured upgrade). Discretionary credits are not a refund and create no entitlement to one.

You are buying immediate publication of editorial content and access to the directory's distribution. The value is delivered as soon as your listing goes live.

3. Backup clause for any consumer purchases

If, despite the warranty in Section 1, consumer-protection law is held to apply to your purchase: you expressly request that we begin providing the digital service immediately upon payment, and you acknowledge that you lose your 14-day right of withdrawal under Art. 6:230o(2) BW once we begin performance. By clicking through to checkout you confirm both the request and the acknowledgement.

4. Editorial discretion

We accept, reject, edit, re-classify, re-rank, and remove listings at our sole editorial discretion. Submission does not guarantee publication. Payment does not guarantee publication. Tier does not buy editorial favour beyond the technical capabilities listed on the pricing page.

Editorial removal of a paid listing — for scope drift, broken site, abandoned product, deceptive claims, or any breach of these terms — is not grounds for a refund.

5. Your representations as submitter

When you submit a listing you represent and warrant that:

• You own or have the right to use all content and imagery you submit.
• Your tool meets the rules in our scope policy.
• The information you provide is accurate and not misleading.
• You'll notify us at hello@citedindex.com if any material fact about your listing changes (acquired, sunset, pivoted, paywalled, repriced).
• You are authorised to submit on behalf of the entity that owns the tool.

6. License to publish

By submitting, you grant CitedIndex a worldwide, non-exclusive, royalty-free, sub-licensable licence to host, display, edit, excerpt, summarise, translate, and promote the submitted content for as long as the listing remains in the directory and to the extent reasonably necessary for archives, backlinks, and historical reference after removal.

7. Acceptable use

You may not use CitedIndex to submit, host, or promote:

• Spam, malware, phishing, or anything functionally deceptive.
• Content that infringes intellectual property or violates publicity rights.
• Content prohibited by NL or EU law.
• Tools whose advertised capability cannot be verified against the live site, including AI-generated "ghost" tools that don't actually exist as a product.
• Content that misleads about pricing, availability, security posture, or compliance certifications.

You may not use the site itself to scrape at high volume, evade rate limits, impersonate the editorial team, or attempt to access non-public admin tooling.

To report a listing that breaches these rules — or to file an IP takedown notice — email hello@citedindex.com with the listing URL, your relationship to the content, and the basis for the report.

8. Liability cap

To the maximum extent permitted by Dutch law, our total aggregate liability to you under or in connection with these terms — whether in contract, tort, or otherwise — is capped at the greater of:

• the amount you paid CitedIndex in the 12 months before the claim, or
• EUR 100.

We exclude liability for indirect, consequential, or special damages — including lost profits, lost rankings, lost AI citations, lost backlinks, and lost revenue.

9. Indemnity

You will indemnify and hold us harmless from any third-party claim arising out of your submission, including IP infringement, defamation, regulatory violations, or breach of your representations under Section 5.

10. Term and termination

These terms apply for as long as you have a listing or an account on CitedIndex. We may remove your listing and terminate your account immediately for breach of these terms or our acceptable use policy.

You can request listing removal at any time by emailing hello@citedindex.com. Removal at your request is not refundable, consistent with Section 2.

11. Governing law and forum

These terms are governed by the laws of the Netherlands. Any dispute arising out of or in connection with these terms will be brought before the District Court of Amsterdam (Rechtbank Amsterdam), to the exclusion of any other forum.

12. Changes

We may update these terms. The "last updated" date below changes when we do. Material changes are flagged to logged-in users. Continued use after the effective date constitutes acceptance of the updated terms.
